When cases are settled through guilty pleas, as Feeley (1979) puts it, the role of the judge is reduced to âratifyingâ the decision which was made earlier by the parties. Still, magistrates and judges decide on the type and tariff of the sanction. Decisions are often justified on a number of factors: deterrence; the cumulative impact that the same type of offences have on the system of immigration controls; the seriousness of the offence; and the immigration status of the defendant.
